Terms and Conditions of Charter Operations<\/h2>\n

Platform:<\/strong> YachttoGO Global Marketplace | Operating Entity:<\/strong> Nomad Group Yat. Turizm Tekstil San. ve Tic Ltd.<\/p>\n<\/div>\n

By accessing, browsing, or executing a reservation on YachttoGO.com, you officially acknowledge that you have read, understood, and agreed to be bound by these operational Terms and Conditions. These terms constitute a legally binding agreement between the user (Charterer or Host) and the platform.<\/p>\n

1. The YachttoGO Ecosystem & Operational Boundaries<\/h3>\n

1.1. Platform Role:<\/strong> YachttoGO operates strictly as an intermediary digital marketplace. We facilitate the connection between vessel owners\/operators (Hosts) and individuals seeking maritime charters (Charterers). YachttoGO does not own, manage, or operate any vessels within the verified fleet.<\/p>\n

1.2. Contractual Independence:<\/strong> Upon the confirmation of a booking, a direct, legally binding charter agreement is formed exclusively between the Host and the Charterer. YachttoGO is not a party to this operational contract and acts solely as a technological and financial facilitator.<\/p>\n

1.3. Liability Limitation:<\/strong> While YachttoGO enforces verification protocols, we do not guarantee the condition, safety, or legal compliance of any vessel. The Host is completely responsible for maintaining valid licenses, maritime insurance, and seaworthiness.<\/p>\n

2. Financial Execution & Cancellation Protocols<\/h3>\n

2.1. Payment Structure:<\/strong> To secure a charter slot, the Charterer must execute a deposit payment via the YachttoGO secure gateway. The remaining balance, alongside any applicable APA (Advance Provisioning Allowance) or security deposits, must be settled directly with the Host prior to embarkation, as dictated by the specific vessel’s terms.<\/p>\n

2.2. Standard Cancellation Policy:<\/strong> Unless superseded by a Host’s specific vessel policy, the following financial retention rules apply to cancelled operations:<\/p>\n

  • 100% Refund:<\/strong> If cancelled within 72 hours of the initial booking confirmation.<\/li>\n
  • 50% Refund:<\/strong> If cancelled up to 60 days prior to the embarkation date.<\/li>\n
  • 25% Refund:<\/strong> If cancelled up to 30 days prior to the embarkation date.<\/li>\n
  • 0% Refund (No-Show):<\/strong> If cancelled less than 30 days prior to embarkation.<\/li>\n<\/ul>\n

    2.3. Security Deposits:<\/strong> Hosts may require a security deposit held against potential damages. YachttoGO is not responsible for the administration, retention, or dispute resolution regarding these specific offline deposits.<\/p>\n

    3. Maritime Compliance & Charterer Responsibilities<\/h3>\n

    3.1. Bareboat Charters (Uncrewed):<\/strong> If operating a vessel without a provided crew, the Charterer must present internationally recognized and valid maritime licenses (e.g., ICC, RYA Day Skipper) to the Host prior to departure. The Host retains the ultimate authority to deny embarkation or enforce the hiring of a professional skipper (at the Charterer’s expense) if the presented credentials or demonstrated competence are deemed insufficient for safe navigation.<\/p>\n

    3.2. Crewed Charters:<\/strong> On crewed vessels, the appointed Skipper is the ultimate maritime authority. The Skipper retains the right to alter itineraries, terminate the charter, or return to port due to severe weather conditions, mechanical failures, or passenger behavior that violates maritime safety protocols.<\/p>\n

    3.3. Vessel Handover (Check-in\/Check-out):<\/strong> The Charterer must execute a physical inspection and sign an inventory log with the Host during embarkation. Any pre-existing damage must be documented. The Charterer is financially liable for any undocumented damage discovered during disembarkation.<\/p>\n

    4. Host (Vessel Operator) Obligations<\/h3>\n

    4.1. Accuracy of Logs:<\/strong> Hosts must ensure all technical specifications, imagery, and availability calendars are strictly accurate. Misrepresentation of a vessel’s condition is grounds for immediate platform termination.<\/p>\n

    4.2. Insurance Compliance:<\/strong> Hosts must maintain comprehensive commercial charter insurance covering third-party liability and hull damage. YachttoGO reserves the right to request proof of active insurance logs at any time.<\/p>\n

    5. Jurisdiction & Dispute Resolution<\/h3>\n

    5.1. Governing Law:<\/strong> These terms are governed by and construed in accordance with the laws of the Republic of Turkey and applicable international maritime law, acknowledging the operational base of Nomad Group Yat. Turizm Tekstil San. ve Tic Ltd. (Fethiye VD: 6311750308).<\/p>\n

    5.2.
